Sorry, Brian. You're wrong this time.
She IS a public figure. She worte and published a book with her face on the cover. The book has sold thousands of copies. It's a New York Times bestseller. She's appeared on The Today show, NPR, Fox & Friends, the Martha Stewart show. Also, she's the author of dozens of articles in national magazines. How is she not a NY Times v. Sullivan "public figure"?

She has to prove actual malice in order to win this suit. It is totally irrelevant whether Seinfeld was doing stand up or being interviewed by Letterman. Remember the 1st Amendment exception for r"hetorical hyperbole"?

Jerry is a comedian on a comedy show. He called a public figure a crackpot and a wacko. He likened her name to the names of assasins. Does this mean that Obama has a right to sue Fox News for calling him a terrorist and calling in to question his mental faculties? At the risk of invoking the "you don't know me" response, I think you know I'm right.
