this line says it all "As long as there is money to be made the Digg Cease and Desist lawyers will stay busy."

if there is money to be made then people will game the system and will do digging for others for money,...this is true everywhere, some people think SU is the best place but it is being gamed by its own POWER users, who game the system by photoblogging their own blog material and then getting thousands of visitors.

What if Usocial is using diggers that are in a jurisdiction where Digg's click wrap in unenforceable? There seems to be the assumption that they're getting their diggers from the US. What if they're using Indians?

I agree in the conventional contract sense where they actually know who the parties really are.

While it's true that Digg would have to prove individual user agreements had been breached to its detriment (and that the breach had been intentionally induced by USocial), it would not require the testimony of the breaching party to establish such a case. If it did, it would be virtually impossible to prove up a tortious interference case because any such claim would require an admission of wrongdoing from the party who had breached the contract. The wonderful world of electronic discovery would make this a much easier case to prove than your analysis indicates.
